Please read these Terms of Service carefully before using ListingLevel. By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Pampa Dev LLC. If you do not agree, do not use the Service. You must be at least 18 years old to use ListingLevel.
2. Description of Service
ListingLevel provides AI-powered photo enhancement for real estate listings, accessible at listinglevel.com and app.listinglevel.com. The Service uses Google Gemini to process uploaded photos. Results are generated automatically and may vary.
3. Account Registration
You must create an account to use the Service beyond the free tier. You agree to:
• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access.
• Be responsible for all activity under your account.
4. Acceptable Use
You agree not to:
• Upload photos that contain illegal content, or that violate third-party rights.
• Use the Service to misrepresent properties in a fraudulent manner.
• Attempt to reverse-engineer, scrape, or abuse the Service infrastructure.
• Resell or sublicense access to the Service without our written consent.
• Use the Service if you are under 18 years of age.
5. Intellectual Property
5.1 Your Content
You retain full ownership of all photos you upload to ListingLevel. By uploading photos, you grant Pampa Dev LLC a limited, non-exclusive, royalty-free license to store, process, and transmit your photos solely to provide the Service to you. This license includes the right to submit your photos to third-party AI processors (currently Google Gemini) as necessary to deliver the enhancement Service. This license terminates when you delete the photos or close your account.
By uploading any photo, you represent and warrant that:
• You own the photo or hold all necessary rights, licenses, and permissions to upload it and to grant the rights described in these Terms.
• You have the right to authorize ListingLevel to submit the photo to third-party AI processors for enhancement purposes.
• If you are uploading photos on behalf of a client, employer, or any third party, you have obtained all required authorizations and consents from that party prior to uploading.
• Your upload does not violate any applicable law, third-party intellectual property rights, privacy rights, or contractual obligations.
You acknowledge that Pampa Dev LLC acts as an intermediary between you and third-party AI processors, and that by uploading photos you are accepting responsibility for ensuring all necessary rights and permissions are in place. If any claim arises from your failure to hold or obtain such rights, you agree to indemnify and hold harmless Pampa Dev LLC in accordance with Section 13 of these Terms.
5.2 Enhanced Output Ownership
You own the enhanced output photos generated from your uploads. However, because the enhancements are produced by AI processing, Pampa Dev LLC makes no representation that the enhanced outputs are independently copyrightable under applicable law. Under current US copyright doctrine, purely AI-generated elements may not qualify for copyright protection. The copyrightability of any specific output depends on the degree of human creative input. We recommend consulting a legal professional if copyright protection of your outputs is important to your use case.
AI-generated outputs are not guaranteed to be unique. Other users processing similar photos may receive visually similar results. We are not liable for any similarity between your enhanced outputs and those of other users.
5.3 ListingLevel Intellectual Property
Pampa Dev LLC owns all rights, title, and interest in and to the ListingLevel platform, including but not limited to: the ListingLevel name and logo, the website and application design and user interface, the AI processing pipeline and underlying technology, all software, algorithms, and code, and all documentation and marketing materials. Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or other brand features without our prior written consent.
5.4 Feedback
If you submit ideas, suggestions, feature requests, or other feedback about the Service, you assign all rights in that feedback to Pampa Dev LLC. We may use your feedback for any purpose without restriction or compensation to you. You waive any moral rights you may have in such feedback to the fullest extent permitted by law.
5.5 DMCA — Copyright Infringement
Pampa Dev LLC respects intellectual property rights and responds to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512). Our DMCA Designated Agent is registered with the U.S. Copyright Office under Registration Number DMCA-1070440.
Photos uploaded to ListingLevel are private and accessible only by the account holder who uploaded them. They are not published, shared, or made publicly accessible through our platform. As a result, uploaded content is not generally discoverable by third parties.
Notwithstanding the above, if you believe that content stored on our Service infringes your copyright, you may submit a written notice to our designated copyright agent at [email protected]. Your notice must include:
• A description of the copyrighted work you claim has been infringed.
• Sufficient information to identify the allegedly infringing material and the account associated with it.
• Your contact information: name, address, telephone number, and email address.
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.
Upon receiving a valid and complete notice, we will investigate and, where appropriate, remove or disable access to the allegedly infringing content and notify the account holder. That user may submit a counter-notice if they believe the removal was in error. Users who repeatedly infringe third-party copyrights will have their accounts terminated.
7. Subscription and Billing
ListingLevel offers Free, Lite, Plus, and Pro subscription tiers. Paid subscriptions are billed monthly in advance through Stripe.
By subscribing to a paid plan, you authorize ListingLevel to charge your payment method on a recurring monthly basis until you cancel.
We may change subscription prices, modify plan features, discontinue subscription plans, or discontinue the Service at any time. Changes apply immediately to new customers and to existing subscribers at the start of their next renewal term, unless applicable law requires different timing or notice. We may also suspend or discontinue the Service before the end of a billing period where necessary for legal compliance, security, fraud prevention, abuse prevention, technical integrity, or other circumstances where continued operation is not reasonably possible. If we discontinue the Service or end your paid access for our convenience before the end of a prepaid billing period, we will provide a prorated refund for the unused portion of your prepaid subscription fees. No refund is owed where suspension or termination results from your violation of these Terms, fraud, abuse, or other unlawful activity, except where required by law.
8. Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. You will not be charged for subsequent periods. No partial-month refunds are issued automatically upon cancellation.
9. Refunds
Refund requests must be submitted to [email protected]. We evaluate refund requests on a case-by-case basis. In general, we will approve refunds for genuine billing errors or service failures, provided there is no evidence of abuse. We reserve the right to deny refunds in cases of misuse or repeated refund requests.
10. AI-Generated Output Disclaimer
Photo enhancements are generated by AI and are intended to improve visual presentation. Enhanced photos may not reflect the precise current state of a property. You are solely responsible for ensuring that listing photos you publish comply with applicable real estate regulations, advertising standards, and professional ethics requirements in your jurisdiction.
ListingLevel makes no warranty that AI-enhanced photos will be accepted by any particular MLS, platform, or regulatory body.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY PARTICULAR RESULT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAMPA DEV LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Pampa Dev LLC from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your uploaded content, or your violation of these Terms.
14. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases and your data will be deleted in accordance with our Privacy Policy.
15. Governing Law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of New Mexico.
16. Taxes
Subscription fees do not include federal, state, local, or foreign taxes, duties, or similar assessments. You are responsible for all taxes associated with your purchase, except for taxes based on our net income. If we are required to collect taxes on your behalf, we will invoice you accordingly.
17. Claims Limitation Period
Any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after the event giving rise to the claim occurred. Claims not filed within this period are permanently barred to the fullest extent permitted by applicable law.
18. Assignment
You may not assign, transfer, or delegate these Terms or any rights or obligations under them without the prior written consent of Pampa Dev LLC. Any attempted assignment without consent is null and void. Pampa Dev LLC may freely assign or transfer these Terms, including in connection with a merger, acquisition, sale of assets, or corporate reorganization, without notice to you.
19. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect. The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
20. Force Majeure
Pampa Dev LLC shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or infrastructure outages, or third-party service failures (including cloud providers or AI services).
21. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Pampa Dev LLC regarding the Service and supersede all prior or contemporaneous agreements, communications, or understandings on that subject.
22. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
