1. Who We Are
Pampa Dev LLC ("ListingLevel", "we", "us", or "our") operates listinglevel.com and app.listinglevel.com. We provide AI-powered real estate listing photo enhancement services. Questions about this policy may be directed to [email protected].
2. Information We Collect
We collect the following categories of information:
• Account information: name, email address, and password when you register.
• Photos you upload: images submitted to our platform for AI enhancement.
• Payment information: billing details processed securely by Stripe. We do not store your full card number.
• Country code provided by Cloudflare's network infrastructure, which indicates approximate location at the country level only.
• Usage data: pages visited, features used, session duration, and browser/device type.
• Cookies and analytics: data collected via Google Analytics (see Section 7).
3. How We Use Your Information
We use your information to:
• Provide, operate, and improve the ListingLevel service.
• Process your photos using Google Gemini AI to produce enhanced listing images.
• Manage your subscription and process payments via Stripe.
• Localize displayed billing currency using that country code. We use this country code solely for currency localization, not for precise location tracking.
• Send you service-related communications (account updates, billing notices).
• Analyze usage patterns through Google Analytics to improve user experience.
• Respond to support requests and legal inquiries.
4. Photo Ownership and Processing
You retain full ownership of all photos you upload to ListingLevel. By uploading photos, you grant us a limited, non-exclusive license solely to process those photos for the purpose of delivering the Service to you. We do not claim any ownership rights over your photos or enhanced outputs.
Your photos are processed using Google Gemini. Google's use of your data in this context is governed by Google's API Terms of Service and Privacy Policy. We do not permit Google to use your photos to train their general AI models under our API agreement.
5. Data Retention
Your photos and enhanced outputs are stored on our servers for as long as your account remains active. You may delete individual photos at any time from your account dashboard.
If you close your account, all photos and associated data are permanently deleted from our systems within 30 days.
If ListingLevel ceases operations, we will provide at least 30 days' advance notice and delete all user photos upon shutdown.
6. Data Sharing and Third Parties
We share your data only with the following parties, and only to the extent necessary to deliver the Service:
• Stripe: payment processing. Governed by Stripe's Privacy Policy.
• Google (Gemini API): AI image processing. Governed by Google's API Terms.
• Google Analytics: usage analytics. You may opt out via Google's opt-out tools.
• Cloudflare: network infrastructure that may provide a country code used solely for currency localization.
We do not sell your personal data. We do not share your photos or personal data with advertisers.
7. Cookies
We use cookies and similar technologies to operate and improve the Service. Specifically:
• Essential cookies: required for authentication and core functionality.
• Analytics cookies: Google Analytics uses cookies to collect aggregate usage data. IP addresses are anonymized.

8. Your Rights
Depending on your location, you may have the right to:
• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request deletion of your data.

9. International Transfers
ListingLevel is operated from the United States. If you access the Service from outside the US, your information may be transferred to and processed in the US, which may have different data protection laws than your country of residence. By using the Service, you consent to this transfer.
10. Children
ListingLevel is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware of such collection, we will delete the information promptly.
11. Security
We implement industry-standard security measures including encryption in transit (TLS) and at rest. However, no system is completely secure. We cannot guarantee absolute security of your information.
12. Changes to This Policy
We may update this Privacy Policy periodically. We will notify you of material changes via email or a prominent notice on the Service at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.
13. GDPR, CCPA, and International Privacy Rights
Lawful Bases for Processing (EEA, UK, and Switzerland)
If you are located in the European Economic Area, United Kingdom, or Switzerland, we process your personal data under the following lawful bases as defined by the GDPR:
• Contract performance: processing necessary to provide the Service you have signed up for, including account management, photo processing, and billing.

• Consent: where we ask for your consent (for example, for non-essential analytics cookies), you may withdraw that consent at any time without affecting the lawfulness of prior processing.
EEA, UK, and Swiss users have the following additional rights under the GDPR:
